SHIPPING & REFUND POLICY

Thank you for visitinghttps://burgrill.in, independently operated by Eat Hearty Private Limited, an Indian based company incorporated under the Companies Act, 2013.

If, for any reason, you are not completely satisfied with a purchase, we invite you to review our policy on shipping & refund.

The following terms are applicable for any products that you purchased with us:

  1. GENERAL TERMS & CONDITIONS

    Some outlets may not sell all menu items, and certain menu items may be subject to limited availability, or availability that is limited to certain times of the day. Please note that the images of menu items on the Website may not precisely match what you receive.

    When you use the Services for Online Ordering through our website, you must select the participating outlet at which your order is placed. Please select your location and pick-up/delivery time carefully, as once you have confirmed your order, it may not be cancelled. You must also select whether you would like to place a pick-up order, or delivery. Not all outlet locations offer both pick-up and delivery, and the availability of in outlet dining may vary.

    If your order is not picked up at the selected time, or if we attempt but are unable, through no fault of our own, to deliver your order at the selected time, your order will be discarded, and no refund will be issued.

    For all orders, Burgrill shall charge, and you authorize us to charge, the payment method you specify at the time you place your order. You will be responsible for all applicable taxes related to your order. Applicable taxes will be charged at the time you are billed. By completing an order, you are agreeing to pay, in full, the prices and all applicable taxes in relation to your order, either by credit card or other permitted payment method.

    Without limiting the generality of any other section of this policy, we reserve the right to limit or refuse any order, or any item or items within an order, you place through the Website. Furthermore, we retain the right to verify the validity of all orders and may cancel any order if evidence of fraud, tampering, or any other violation of this Policy is found. All orders are subject to verification at any time and for any reason.

  2. HOME DELIVERY CHANNELS

    Burgrill is running Home Delivery Service (hereinafter referred to as “Burgrill Home Delivery”) via following channels (through its franchise partners and its equity owned stores in India):

    • Burgrill website viz.
    • Offline Burgrill Stores pan India
    • Online Food Delivery Platforms including Zomato, Swiggy, etc.
  3. DELIVERY/ SHIPMENT

    The successful delivery of your order, in accordance with our Shipment Policy, is dependent upon the following factors:

    • Customer addresses must fall within the designated delivery area, which is determined by Burgrill at its discretion and may be subject to periodic changes.
    • The delivery address should be aligned with the nearest outlet that provides delivery services to the customer's area.
    • The availability of Burgrill's products and services.
    • The outlet must be online and capable of accepting delivery orders.
    • If the delivery locality is not included in the outlet map, placing delivery orders is not possible. However, you might have an option to pick up your order from the nearest Burgrill outlet, provided this service is available at the respective Burgrill outlet.

    Once the order has been placed successfully it cannot be changed or cancelled by the customers for any reason. You may get updated on the status of the order by calling the outlet directly.

    The acceptance of order shall be at the entire, sole and absolute discretion of Burgrill. Burgrill further reserves the right to refuse or to accept or to cancel any order from any customer beyond the delivery area, without assigning any reasons, if:

    • In case of non-receipt of payment in full or in part in any previous order or the current order; or
    • If there is a trend of frequent frivolous complaints and consequent replacements; or
    • If customer has provided wrong, inaccurate, incomplete or incorrect address; or
    • If customer's address is not falling in defined delivery area of the nearest or any other outlet or beyond the delivery area of Burgrill; or
    • In view of difficult operating conditions for Burgrill Home Delivery like heavy traffic or bad weather condition or New Year's Eve, during festivals like Holi, Ganesh Chaturthi, Christmas, Diwali and Navratri, etc., or in instances of political rallies, processions etc.;

    It shall be the sole and absolute responsibility of the customer to ensure that delivery instructions are clear and precise.

    It is clarified that Burgrill Home Delivery is not available at all outlets. To check whether Burgrill Home Delivery is available in your area, customers need to refer to the information and details disclosed in the respective Home Delivery channels, as disclosed above.

    All Orders/ Purchases shall be shipped to your location from our outlets pan India. Our endeavour is to make the products reach you within 20-45 Minutes from receipt of order and payment depending on the address for delivery. Burgrill shall use its best efforts to meet the scheduled delivery time, however, it does not guarantee these delivery timelines in every case. Burgrill shall not have any liability to customer if the customer's order fails to meet in whole or in part such scheduled delivery time.

    Order deliveries will be made by our own staff / third party aggregators and logistics companies on all days (Monday-Sunday).

    We shall not be responsible for any damage of products post-delivery.

  4. LATE NIGHT DELIVERY

    Late night delivery is applicable in the selected outlets of Burgrill within the territory of India, subject to the local laws and availability of stocks/ riders in the outlets. Delivery Charges, Outlet Handling/ Packaging Charges and other charges will be applicable to all delivery/ takeaway orders on each invoice/bill. Only Takeaway/ Delivery is allowed in case of Late-Night orders. Burgrill reserves the right to modify the Late-night delivery terms & conditions (including charges) and the same will be communicated to the customer on checkout page of the order.

  5. PRODUCT PRICE

    All orders are acknowledged at current pricing.

    However, the prices are subject to change without advance notice. Prices for Online Ordering from our website may also differ from those for purchases made through other Home Delivery Channels.

    Charges paid for completed orders may not be cancelled, returned or refunded. Burgrill has no obligation to provide refunds or credits.

    The price of Burgrill products in all states where Burgrill is operating its outlets is exclusive of the ‘Goods and Services Tax (GST)' at applicable rates and ‘Outlet Handling/ Packaging' charges.

    Thus, the customers are liable to pay Outlet Handling/ Packaging charges, as applicable in that particular area.

    Cashback or Discount on Payment page:
    • Cashback or Discount offered on the payment method selection page of Burgrill is given by the respective payment method partners/third parties. These discounts are not being provided by Burgrill.
    • While we provide the details of the offers and promotions on our portals, we request you to kindly keep yourself updated of the changes and alterations that maybe carried out by the respective payment method partners/third parties.
    Delivery Charges:

    Shipping and handling rates may vary based on the food item, packaging, size, volume, type and other considerations of the order. The shipping and handling charges are given at the time of check out and consumers shall re-confirm before making payments.

    We have no jurisdiction on this and any disputes or queries on exchange rates and bank charges need to be directed to the bank or institution that issued your card or payment instrument.

  6. PAYMENT

    Payment is an integral part of an online ordering experience. All payments shall be collected through secured payment options such as Credit Cards, Debit Cards, Net-Banking, Wallets, UPI, Buy Now Pay Later Options etc. All payments for purchases made by you on the website shall only be in Indian Rupees only. However, we reserve the right to change the permitted methods of payment, including without limitation, the credit cards and/or other types of payment options we are able to accept, at any time.

    While placing the order on the eligible Burgrill Home Delivery Channels, customers may choose the Online payment option, upon which they shall be redirected to an external payment gateway for effecting the online payment. The payment gateway is not under Burgrill's purview, control or discretion, and Burgrill is not responsible for and shall not be liable to any extent or in any manner for any payment-related or internet-related issues faced by customers in relation to online payments including payment refunds, and customers shall indemnify and keep fully and effectively indemnified Burgrill and its affiliates in this regard.

    In case the order which is paid through digital payment method is cancelled due to non-availability of the ordered product at the outlet or any unforeseen circumstance which renders the order fulfilment impossible on part of BURGRILL or the outlet, the amount will be returned by reversing the transaction by Burgrill outlet. This refund will be returned on the actual source within 5 to 7 working days. However, Burgrill is not responsible for any delay on the bank's side or on third party payment gateway's side.

  7. RETURN/ REFUND

    Any case of refund is at the sole discretion of Eat Hearty Pvt Ltd.

    If the parcel/ products are defective, or damaged in transit or received a wrong order, you are eligible for refund in the form of complimentary food items. Unfortunately, we can't offer you a refund in original mode of payment in case of online payments/ cash for the perishable food items

    To be eligible for such complimentary refund, we shall require a proof or picture of the parcel/ food items with original packaging.

    If you desire to seek a complimentary refund for any reason, including if the products are unsatisfactory or for other reasons, you must request the same along with order number within 24 hours of delivery, by either:

    1. sending an email to
    2. posting a feedback under “Feedback Form” on our website.
    3. contacting Customer Care/ Chat Bot of third-Party Aggregators (If ordered through Zomato/ Swiggy etc.)

    Please allow us 48 hours from the day you initiate the refund of your damaged package or an item not as per your order, for your request to be processed. You will be contacted once your request is complete.

    For orders that are not acceptable, Eat Hearty Pvt Ltd reserves the right, to refuse or cancel any refund. The company's decision shall be final and binding on such refund arrangement.

  8. GOVERNING LAW:

    In case of any dispute with respect to Burgrill's Shipping Policy, we shall try to fix the issue amicably. However, the decision of Burgrill shall be final and binding on all concerned.

    Disputes, if any, are subject to the jurisdiction of the competent courts at New Delhi only.

THIS SHIPPING & REFUND/ CANCELLATION POLICY HAVE TO BE READ IN CONJUNCTION WITH OUR PRIVACY POLICY, AVAILABLE ON THE BURGRILL WEBSITE AND THAT MAY BE AMENDED BY BURGRILL FROM TIME TO TIME. THEREFORE, IT IS THE RESPONSIBILITY OF THE CUSTOMER TO KEEP HIMSELF/HERSELF INFORMED OF ANY AND ALL SUCH UPDATES.

BY USING THIS WEBSITE OR ORDERING PRODUCTS FROM THIS WEBSITE YOU AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THIS POLICY.
